These Terms of Service govern your use of IVKits, a field inventory and drug-log platform for mobile IV therapy operations, operated by LibertyLab LLC, a Florida limited liability company ("we," "us"). By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.
Who can use IVKits
IVKits is a business-to-business service intended for mobile IV therapy companies and similar healthcare-adjacent field operations. You must be at least 18 years old and have authority to enter into agreements on behalf of your business to create an account.
Acceptable use
You may use IVKits to manage your team's field inventory, log supply usage, track lot numbers and expiration dates, and coordinate restocking. You may not:
- Use IVKits to store patient names, patient records, or any protected health information (PHI).
- Attempt to reverse engineer, copy, or resell the service.
- Use the service in a way that violates any applicable law or regulation.
- Attempt to gain unauthorized access to other accounts or our infrastructure.
- Use automated tools to scrape or extract data from the service at scale.
We reserve the right to suspend or terminate accounts that violate these terms.
Your data
The operational data your team enters into IVKits (supply lists, inventory counts, usage logs) belongs to you. We store it to operate the service and will not share it with third parties for their benefit. See our Privacy Policy for full details on data handling, retention, and your export rights.
Billing and payment
- Billing cycle. Subscriptions are billed monthly or annually, paid in advance, at the rates published on the pricing page at the time you subscribe.
- Payment. Payment is processed by our third-party payment processor at the start of each billing cycle. You authorize us to charge your payment method on file.
- Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You retain access to the service through the end of the period you have already paid for.
- No refunds for partial months. We do not issue refunds for partial billing periods. If you cancel mid-month (or mid-year on an annual plan), you will retain access through the end of the period and will not be charged again.
- Price changes. We will give you at least 30 days notice before any price increase takes effect on your account.
Service availability
We aim to keep IVKits available and reliable, but we do not guarantee uninterrupted uptime. We will make reasonable efforts to notify customers of planned maintenance. We are not liable for losses caused by service outages beyond our reasonable control.
Termination
Either party may terminate the relationship at any time. You may cancel your account at any time through the application or by emailing [email protected]. We may suspend or terminate your account immediately if you materially violate these terms, fail to pay, or engage in conduct that puts the service or other users at risk. Upon termination, you have 90 days to export your data before it is deleted.
Limitation of liability
IVKits is provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied. In no event will our liability for any claim related to the service exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
IVKits is a field inventory tool. It is not a patient record system, a clinical decision support system, or a medication management system. Decisions about patient care remain entirely with your licensed clinical staff. We have no liability for clinical decisions made by your team.
Indemnification
You agree to indemnify and hold LibertyLab LLC harmless from any claims, damages, or expenses, including reasonable attorney's fees, arising from your use of the service in violation of these terms, including but not limited to any unauthorized entry of protected health information or other regulated data into the system.
Governing law
These terms are governed by the laws of the State of Florida. Any disputes that cannot be resolved informally will be resolved in the courts of Lake County, Florida, and you consent to that jurisdiction.
Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify active customers by email at least 14 days before the changes take effect. Continued use of the service after that date constitutes acceptance of the updated terms.
